We continue to progress in our legal appeal against TCEQ and Vulcan. Our attorneys recently filed the initial brief in our case opposing the Vulcan air quality permit: Friends of Dry Comal Creek and Stop 3009 Vulcan Quarry v. Texas Commission on Environmental Quality and Vulcan Construction Materials, LLC.
TCEQ is being represented by the Office of the Attorney General, so this is truly a David versus Goliath battle.
It will likely be several more weeks before TCEQ and Vulcan respond to our brief. Then we will reply to their responses and the judge will convene a hearing—perhaps by November or December. The hearing with the judge will be open to the public (and we will want to show up in full force!), although, considering Covid-19, we are not sure at this time what format it will take.
